These Terms of Service (the “Terms”) govern access to and use of Archivian. They apply to free use and, once offered, paid plans. Mandatory rights that cannot lawfully be excluded remain unaffected.
1. About Archivian and the contracting party

2. Definitions
- Customer means the person or organization that adds, configures, or purchases Archivian for a Discord server.
- Consumer has the meaning given by applicable German consumer law.
- Business Customer means a customer acting predominantly for commercial or self-employed professional purposes.
- Community Member means a Discord user who interacts with a server in which Archivian operates, whether or not that user has an Archivian account.
- Customer Content means content, configuration, records, and instructions submitted to or processed through the Service by or for a Customer.
- Service means Archivian's website, dashboard, Discord bot and app integrations, APIs, moderation and security functions, and related services.
3. Eligibility and authority
A purchaser must have legal capacity to enter the contract. A person acting for a company, organization, or Discord community confirms that they are authorized to bind that Customer. The eligibility of an ordinary Community Member is governed primarily by Discord and the server they use; a Community Member does not accept a paid subscription merely by being present in that server.
4. The Service
Archivian provides configurable Discord moderation, safety, record-keeping, verification, server-management, and automation functions. Available functions can differ by plan, Discord permissions, configuration, and technical availability. Current product descriptions and the features presented before checkout form part of the agreed service description; marketing examples do not create an enterprise service-level agreement.
5. Discord integration and permissions
The Service depends on Discord's APIs, gateway, permissions, accounts, and platform rules. The Customer is responsible for installing Archivian with appropriate permissions and for maintaining a valid Discord server and account. Missing permissions, Discord outages, rate limits, API changes, policy changes, or removal of the app can limit or interrupt features. Discord is a separate service provider and its own terms and privacy practices apply.
6. Customer responsibilities
The Customer must:
- configure Archivian lawfully and only for Discord servers it is authorized to manage;
- understand that Archivian stores all message content for a configurable retention period of 14-30 days on standard plans, and longer where offered to paying customers at checkout;
- ensure that the use of message tracking complies with applicable data protection laws and Discord's Terms of Service;
- provide appropriate notice to users about message tracking, including that it is mandatory and the retention periods;
- establish appropriate retention periods within the 14-30 day standard range, or within the longer range offered at checkout;
- ensure that indefinite retention of "claimed" messages (reported, bulk-purged, auto-mod flagged) is justified and limited to necessary cases;
- respond to data subject requests regarding messages in accordance with applicable law;
- use message data only for legitimate moderation, administrative, and operational purposes;
- give Community Members any notices and obtain any legal basis or consent required for the Customer's use of moderation, logging, or monitoring features;
- limit staff access and review staff permissions regularly;
- review high-impact rules, retention choices, automated actions, and security settings before enabling them;
- keep account credentials and access links secure and promptly report suspected compromise;
- review Archivian's notices about data-subject requests and respond to lawful requests where the Customer is the controller;
- not instruct Archivian to process unlawful, infringing, or unnecessarily excessive data;
- ensure that any files uploaded to Archivian are free from malware, viruses, or other harmful components before upload, and must use appropriate security measures to scan files;
- not upload files that violate applicable law, Discord's terms, or third-party rights, including but not limited to copyrighted material, illegal content, or content that infringes on privacy rights;
- comply with all applicable laws when collecting, uploading, or storing files, particularly when files contain personal data or sensitive information.
7. Automated moderation and security functionality
According to Customer configuration, Archivian may detect activity and automatically take actions including, but not limited to: deleting messages, creating moderation cases, applying or removing roles, issuing strikes, timing out, kicking, or banning users, adjusting channel settings, sending alerts, running verification, detecting raids or abuse, and performing supported backup or rollback actions.
Automated detection can produce false positives and false negatives. Customers must test and monitor high-impact configurations and use human review where appropriate. Archivian does not guarantee that every raid, abusive message, moderation incident, data loss, or security event will be detected, prevented, or reversed.
8. Free and paid plans
Archivian may offer free and paid plans. Features, usage allowances, retention options, and limits are described on the pricing page or at checkout. Paid-plan provisions apply when paid subscriptions are made available. We may change or discontinue a free plan on reasonable notice where practicable.
9. Subscriptions, billing, and renewal
Paid plans may be billed monthly or annually at the price, currency, billing interval, and tax treatment shown immediately before the order is placed. Unless checkout states otherwise, a paid subscription automatically renews for successive periods of the same length until cancelled. The purchaser authorizes the merchant identified at checkout and its payment provider to charge the selected payment method for recurring amounts disclosed at checkout.
A transaction may be sold directly by Archivian with Paddle acting as payment processor, or through a merchant-of-record arrangement identified at checkout. If a merchant of record is used, that merchant's checkout terms, invoicing, tax, refund, and transaction-support terms also apply. The identity of the merchant of record shown at checkout controls for that transaction.
10. Upgrades, downgrades, and plan changes
The timing and financial effect of an upgrade or downgrade will be shown before confirmation. Upgrades may take effect immediately with a prorated charge or credit. Downgrades normally take effect at the end of the current billing period unless checkout or the account portal states otherwise. A downgrade may reduce limits or features; the Customer should export or remove data that exceeds the new plan's limits before the change takes effect.
11. Price changes
Price changes do not affect a billing period already paid. For a renewing subscription, we will provide reasonable advance notice of a price increase and its effective date. The Customer may cancel before the increase takes effect. We will obtain additional consent where required by law rather than relying on this clause alone.
12. Cancellation and end of paid benefits
Customers may cancel using the cancellation method made available in the dashboard, payment portal, or website. Unless the cancellation flow expressly states otherwise, cancellation stops renewal and paid benefits continue until the end of the already-paid billing period. Statutory rights to extraordinary termination remain unaffected. Consumers will be provided the cancellation mechanism required by applicable German law when paid subscriptions launch.
13. Failed payments and suspension
If a payment fails, the payment provider may retry it and we may notify the purchaser. We may suspend paid-only features after reasonable notice and an opportunity to cure, unless immediate action is required to prevent fraud or harm. The exact retry and grace-period behavior will be displayed in the billing interface or communicated with the failed-payment notice. We will not delete Customer Content solely because of one failed payment without a separate retention notice.
14. Refunds, taxes, and statutory consumer rights
Prices and whether taxes are included will be shown before purchase. Except where the checkout or our Refund Policy states otherwise, payments are not voluntarily refundable for a partially used billing period. This does not limit mandatory rights, including remedies for non-conforming digital services or a valid withdrawal.
Withdrawal rights
Consumers may have a statutory right to withdraw from a distance contract. Before a consumer order is placed, Archivian or the merchant of record will provide the legally required withdrawal instructions and model form. Performance before the withdrawal period ends, and any expiry of the right for digital content or services, will rely only on a legally compliant express request, consent, and acknowledgement where required. Nothing in these Terms itself waives a statutory withdrawal right.
Refund Handling for Early Termination
When a paid subscription ends before the end of a billing period the Customer has already paid for, we handle the prepaid fee as follows. If we end the subscription for reasons that are not caused by the Customer's breach of these Terms, for example, because we discontinue the Service or a plan, or can no longer provide it as agreed, we will reimburse the proportionate share of the prepaid fee for the unused part of the period; for an annually billed plan, that is the unused part of the year. If we terminate for cause because of the Customer's material breach of these Terms, the fee remains earned for the part of the period used, and we will reimburse the proportionate share for the unused part unless, and only to the extent that, we set it off against documented claims the breach has caused us; any set-off will be explained together with the refund calculation. We will reimburse without undue delay and in any event within 14 days of the termination taking effect, using the original means of payment unless otherwise agreed. Where a merchant of record sold the subscription, that merchant's refund terms govern the transaction and we will make the amounts to be reimbursed available to it. Statutory rights remain unaffected, including the consumer rights described in this Section and rights where a digital service is terminated early or was not provided as agreed.
15. Trials and promotions
If trials or promotional periods are offered, their duration, eligibility, post-trial price, and whether a payment method will be charged automatically will be shown before enrollment. Archivian does not currently promise that a trial or promotion will be available.
16. Customer Content and Discord data
As between Archivian and the Customer, the Customer retains its rights in Customer Content. The Customer instructs Archivian to host, reproduce, transform, transmit, and otherwise process Customer Content only as needed to provide, secure, support, and improve the Service and meet legal obligations. This license ends when the relevant content is deleted, subject to backups, legal retention, unresolved abuse or security matters, and records that must remain for other lawful purposes.
The Customer must not upload content it has no right to process. Archivian does not acquire ownership of Discord messages, moderation records, server configurations, or uploaded files merely by processing them.
17. Data protection
Archivian processes personal data in two capacities:
- As a controller: For data related to your Archivian account, authentication, service improvements, security, and platform operations. The Privacy Policy details this processing.
- As a processor: For data relating to Discord servers where Archivian operates, where the Customer (server) is the controller. The DPA governs this relationship.
Data Processing Agreement
By using Archivian, you agree to our Data Processing Agreement (DPA), which governs how we process personal data on your behalf as your processor. The DPA is made available to you before you connect Archivian to a server. The DPA is incorporated into and forms an integral part of these Terms of Service. The DPA is available here.

18. Acceptable use
Customers and users must not:
- use the Service unlawfully or to harass, stalk, discriminate against, or endanger people;
- circumvent access controls, or interfere with Service integrity, scan, probe, or test systems for vulnerabilities without authorization;
- scrape, automate, crawl the Service beyond normal browser use;
- attempt to gain unauthorized access of the Service, use other users' sessions, or alter others configurations
- make excessive uploads or use the Service in a way that creates unreasonable load;
- upload files that contain malware, viruses, or other harmful code, or that are designed to exploit vulnerabilities in Archivian's systems;
- upload files that contain illegal content, including but not limited to child sexual abuse material, extremist content, or other prohibited material under applicable law;
- upload files that infringe third-party intellectual property rights or other rights;
- resell or provide access to the Service except as expressly permitted;
- use Archivian to make solely automated decisions producing legal or similarly significant effects without an appropriate lawful basis and safeguards; or
- violate Discord's applicable terms or platform policies.
19. Third-party services
The Service interoperates with Discord and may use hosting, storage, communications, analytics, error monitoring, and payment providers. Their availability can affect the Service. Current data-processing providers are described in the Subprocessor List. Third-party links and independent services are governed by their own terms.
20. Intellectual property
Archivian and its licensors retain all rights in the Service, software, branding, documentation, and non-Customer materials. Subject to these Terms and payment where applicable, the Customer receives a limited, non-exclusive, non-transferable right to use the Service during the contract term.
21. Feedback
If you voluntarily send us feedback, suggestions, or ideas about the Service, you do so in the expectation that we may use, implement, adapt, and share them to improve and operate the Service, without obligation to you and without payment.
This applies only to general feedback and ideas that are not protected works or trade secrets, and it does not transfer ownership of Customer Content, personal data, or anything you share in confidence with us. Sending feedback is optional and never affects your use of the Service; we are not required to use, respond to, or keep feedback confidential. If you want a submission treated as confidential or compensated, tell us before you send it so we can agree on that in writing.
22. Availability and changes
Archivian may perform maintenance and change the Service to improve security, comply with law or Discord requirements, prevent abuse, or develop the product. We will not materially reduce the core paid service during a current paid term without a valid reason. Where a foreseeable change materially disadvantages a Customer, we will give reasonable notice and any termination or remedy required by law. No uptime or service-support response-time SLA applies unless separately agreed in writing. This does not limit any statutory deadline or obligation applicable to a data-subject request.
23. Suspension and termination
We may suspend or terminate access for:
- Material breach: Serious violations of these Terms, including but not limited to using Archivian for illegal purposes, harassment, uploading files containing malware, illegal content, content that violates third-party rights, or to violate Discord's terms or policies. A single serious breach may justify suspension or termination without prior notice.
- Repeated breach: Repeated violations of these Terms after notice and a reasonable opportunity to cure.
- Non-payment: Failure to pay after notice and reasonable opportunity to cure, except where immediate action is required to prevent fraud or harm.
- Legal or platform requirements: When required by law, court order, Discord or other platform requirements, or to protect the rights, property, or safety of Archivian, our users, or the public.
- Abusive or excessive use: Use that places an unreasonable or disproportionate burden on our systems, resources, or infrastructure, or that exceeds reasonable usage patterns. We will provide notice and an opportunity to cure before terminating for this reason, unless immediate action is necessary to prevent harm.
- Credible threat: When there is a credible threat to users, the Service, or our operations.
Except where urgent action is necessary (such as to prevent imminent harm, fraud, or legal violations), we will provide notice and a reasonable opportunity to cure before suspending or terminating.
Customers may stop using the free Service at any time and may cancel paid plans as described above.
Provisions that by their nature should survive termination—including accrued payment obligations, intellectual property, and liability rules—remain in effect.
Suspension, cancellation, or termination does not by itself erase Customer Content or personal data. Removing Archivian from a server starts the seven-day termination period described in the Data Processing Agreement; if Archivian is not re-added and deletion is not paused at the Customer's written request, Server-Specific Data is deleted after that period. Other return, deletion, and retention questions are handled under the Privacy Policy, the applicable Data Processing Agreement, Customer instructions, and applicable law.
Data-subject rights remain available after access to the Service ends.
24. Liability
Archivian has unlimited liability for intent and gross negligence; injury to life, body, or health; fraudulent concealment; guarantees expressly assumed; and liability that cannot be limited by law, including under the German Product Liability Act where applicable.
For slight negligence, Archivian is liable only for breach of an essential contractual obligation whose performance is necessary for the contract and on which the Customer may ordinarily rely. In that case, liability is limited to damage typical for the contract and reasonably foreseeable when the contract was formed. Statutory consumer rights and legally mandatory remedies remain unaffected.
Within those lawful limits, Archivian is not responsible for damage caused by Customer configuration, missing Discord permissions, unlawful Customer Content, Discord or subprocessor outages or changes outside our control, or a Customer's failure to review automated actions.
Uploaded files and their content are not checked for safety or legality by Archivian beyond the automated scanning it may choose to perform, and Archivian is not a guarantor of uploaded files. The Customer is responsible for what it and its users upload, including that uploads are free of malware or other harmful components, lawful, and respectful of third-party rights. Where damage arises from the content of an uploaded file itself, such as a harmful file affecting a Customer's or third party's systems, the liability limitations and exclusions in the paragraphs above apply, so far as law permits, to that damage as they apply to other damage. This does not limit Archivian's liability under those paragraphs for damage Archivian itself causes, including through its own breach of essential contractual obligations while storing or processing a file.
Reporting Violations
If you believe that files or content stored through Archivian violate your rights or applicable law, please contact us at [email protected]. We will review reports and take appropriate action, which may include removing or blocking access to the reported content, in accordance with applicable law.
Customers who believe that their content was wrongfully removed may contact us to contest the removal.
Technical Limitations
Archivian may impose limits on file sizes, file types, and upload volumes to ensure system stability and security. These limits may vary by plan and are subject to change.
Scanning and Security
Archivian may implement automated security scanning for uploaded files. However, Customers remain responsible for ensuring files are safe before upload. Archivian does not guarantee that all malicious files will be detected or prevented.
Data Protection Considerations
Files uploaded to Archivian may contain personal data. Customers must ensure they have a lawful basis for collecting and processing such data in accordance with applicable data protection laws, including the GDPR. Archivian processes such data as a processor under the Data Processing Agreement.
25. Business Customer responsibility
A Business Customer is responsible for third-party claims caused by its unlawful Customer Content or instructions to the extent the Business Customer is at fault. This clause does not apply to Consumers and does not require the Customer to cover claims caused by Archivian's own breach or fault.
26. Changes to these Terms
We may update these Terms for future contracts at any time. Changes to an existing paid contract require a valid reason, such as a change in law, security needs, Discord requirements, or Service functionality. We will provide reasonable advance notice of material changes. If consent is required by law, silence will not be treated as consent. The notice will explain the effective date and any right to reject or terminate.
27. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For a Consumer, this choice does not deprive the Consumer of mandatory protections of the law of their habitual residence. Courts have jurisdiction as provided by applicable law. For merchants, legal entities under public law, and special funds under public law, the courts at Archivian's German place of business have exclusive jurisdiction to the extent a forum agreement is legally permitted.
28. General provisions
If a provision is invalid, the remaining provisions continue to apply; the statutory rule replaces the invalid provision. Failure to enforce a provision once is not a waiver. A Customer may not transfer its contract without our consent, except where mandatory law permits it. Archivian may transfer the contract as part of a genuine business succession only with the notice and termination rights required by law.
